Terms of Purchase
1. The owner of the website kemis.pl is M.Pańkowski – Labopak System Sp.K. | ul. Batorego 4 | 05-400 Otwock, KRS 0000134024, NIP 5321821157, REGON 015269070 – hereinafter referred to as KEMIŚ.
2. KEMIŚ conducts wholesale sales to entities conducting business activities. KEMIŚ does not conduct retail sales.
3. Terms and Conditions – these Terms of Purchase for the website kemis.pl.
4. Store - a domain allowing the purchase of KEMIŚ products electronically, available at the internet address: www.kemis.pl. Logging into the kemis.pl website, as well as going through the ordering process, requires Registration.
5. Registration – providing the required data in the Form and creating an Account in the Store. Acceptance of the Terms and Conditions and the Privacy Policy is required for Registration.
6. Form – a form available in the Online Store that allows the creation of an Account.
7. Client – a registered user of the Store with an Account.
8. Account – a set of resources in the KEMIŚ ICT system identified by an individual name (login) and password provided by the Client, where the data provided by the Client and information about their Orders in the Store are collected.
9. Order - a declaration of the Client's will submitted via the Form and directly aimed at concluding a Product Sales Agreement with KEMIŚ.
10. Product – a movable item available in the Online Store that is the subject of the Sales Agreement between the Client and KEMIŚ. All products offered in KEMIŚ are new, free from physical and legal defects, and have been legally introduced to the Polish market. An exception may be products in the "sale" section, where the defect description is precisely described.
11. Sales Agreement – a transaction of exchanging a Product for money concluded or concluded between the Client and KEMIŚ via the Store.
12. The Client is obliged to use the Online Store in accordance with the law and good customs, taking into account respect for personal goods and intellectual property rights of KEMIŚ and third parties, and to provide data consistent with the actual state.
13. All prices listed on the website are net prices (do not include VAT) given in Polish zloty. The price listed for the product at the time the order is placed by the Client is binding for the transaction parties.
14. The Client is informed about the total price, including taxes, of the Product being the subject of the Order, as well as about the delivery costs (including transport, delivery fees) and other costs, and if it is not possible to determine the amount of these fees – about the obligation to pay them, on the Store's pages during the Order placement, including at the moment of the Client's expression of will to be bound by the Sales Agreement.
15. KEMIŚ reserves the right to execute a partial order if the actual warehouse stock differs from the state provided on the website. Reducing the order due to KEMIŚ's fault does not affect the automatically granted privileges and discounts.
16. Before shipment, a visual registration of the sent goods is conducted, constituting assistance in submitting complaints regarding the content of the shipment.
17. The shipping realization time is 1-3 business days. At the same time, KEMIŚ makes every effort to shorten the shipping time as much as possible.
18. KEMIŚ indicates that due to transactions being conducted between entrepreneurs, the Client is not entitled to withdrawal and other rights resulting from the Consumer Rights Act.
19. The delivery of the Product is available in Poland. Delivery outside Poland may be subject to individual arrangements between the Client and KEMIŚ.
20. The Buyer agrees to receive VAT invoices and corrective invoices from KEMIŚ electronically without the issuer's signature at the email address provided when placing the order.
21. Complaints are accepted via the form available in the Customer Panel. In the complaint, please provide: invoice number, product catalog number, description and type of damage, photos documenting the damage. The complaint will be considered within a maximum of 10 business days.
24. Permission is granted to electronically copy and print portions of the site solely for the purpose of placing an order with KEMIŚ or using this site for shopping purposes. Any other use of materials from this website - including reproduction for purposes other than those mentioned above, modification, distribution, or publication - without the prior consent of KEMIŚ is prohibited.
25. The administrator of personal data is KEMIŚ. The administrator takes special care to protect the interests of the persons whose data are processed.
26. Providing personal data by the buyer is voluntary, but necessary to complete the order.
27. Every person whose personal data is processed by KEMIŚ has the right to individually control, correct and supplement, delete, restrict their processing, transfer them, and file a complaint with the supervisory authority. (The full text of the privacy policy is available here).
28. The personal data of Clients obtained by the administrator via the Online Store are collected - according to the Client's will - for the purpose of executing the Sales Agreement.
29. KEMIŚ reserves the right to change the assortment and its prices presented on the wholesale platform and to conduct and end promotional campaigns ahead of time.
30. KEMIŚ reserves the right to errors in the ICT system serving the platform regarding product availability.
31. KEMIŚ is not responsible for the operation of interfaces and telecommunication links that are not its property or are not operated by it, in particular, interfaces used to conduct transactions by the Client.
32. The Client has the option, at any time and without giving a reason, to delete the Account (resign from the Account) by sending an appropriate request to KEMIŚ.
33. KEMIŚ is entitled at any time to unilaterally introduce changes or additions to these terms and conditions, which the Client will be informed about by email. If the Client does not object to the changes within 14 days, the Terms and Conditions apply to them in the new form, with the introduced changes.
34. The conditions of cooperation are determined solely by the Terms and Conditions. All informational or advertising materials regarding cooperation and the Service are for informational purposes only and are not legally binding.
35. The common court competent to resolve disputes arising from the terms and conditions is the court competent for the seat of KEMIŚ.
Settlements of transactions with payment cards and e-transfers are carried out via Dotpay.pl / TPAY.
